By purchasing, accessing, or using Groundya™, you agree that:

1. General Information

These Terms apply to:

  • Groundya™ digital products

  • program.groundya.com platform

  • optional community spaces

  • all materials and content

Definitions:

Platform — website and program.groundya.com
User / You — any person aged 16+
Materials — all guides, rituals, and content
Digital Product — PDF guide and related materials
Physical Tool Set — physical accessories shipped separately
Groundya™ System — 28-Day Skin Comfort System

We may suspend or terminate access at any time for safety or misuse.
No refunds apply for removals due to violations.

2. Product Structure

Groundya™ Skin Comfort System is a digital educational product.

The product may include:

  • access to program.groundya.com (primary product)
  • access instructions delivered via PDF or email (access tool only)
  • optional community features
  • Physical Tool Set

The Physical Tool Set may include:

• Cooling Stainless Steel Spatula
• Reusable Silicone Hydration Mask
• Soft Microfiber Spa Headband

3. Digital Product Delivery

3.1 Instant Delivery

Digital products are delivered immediately via email or download page.

The product is considered delivered when access instructions (PDF or email) and access to the platform (program.groundya.com) are provided.

3.2. Digital Products and Right of Withdrawal

By purchasing Groundya™, you expressly consent to the immediate delivery of digital content and acknowledge that you lose your right of withdrawal once access to the digital product has been provided.

If you are a consumer in the European Union, this consent is given in accordance with applicable consumer protection laws regarding digital content.

Once access to the program or platform is granted, the product is considered fully delivered and non-refundable, except where required by applicable law.

3.3 Personal License

You receive a personal, non-transferable license.

4. Physical Tool Set

4.1 Nature of Tools

Tools are not medical devices and are not intended to affect the structure or function of the body.

4.2 Responsibility

Groundya™ is not responsible for misuse, hygiene issues, or reactions.

4.3 Shipping (Legal Overview)

Physical components are shipped separately.

Delivery times are estimates only.

Groundya™ is not responsible for carrier delays.

Risk of loss or damage transfers to the User upon delivery of the physical tools to the provided shipping address.

Users are responsible for correct shipping details.

International orders may include customs fees paid by the User.

5. Access to the Online System

5.1 Activation

After purchase, you receive access instructions (via PDF or email) and a link to access program.groundya.com.

You must activate access using the same email.

Access must be activated within 72 hours from purchase.

Failure to activate access within this time for reasons not attributable to Groundya™ does not constitute grounds for refund.

Access may no longer be available after this period.

5.2 Modifications

We may update or modify the system at any time.

5.3 Community

Community features are optional and may be removed at any time.

5.4 Duration

Access is guaranteed for a minimum of 28 days from activation.

6. Payments

Payments are processed via:

  • Shopify Payments

  • PayPal

We are not responsible for third-party payment errors.

6.1 Disputes & Chargebacks

If a dispute or chargeback is filed through PayPal or a payment provider:

  • access may be suspended

  • accounts may be restricted

  • future purchases may be blocked

7. Refund Policy

7.1 Digital Products

Digital products are non-refundable once delivered.

7.2 Product Definition

You acknowledge that:

the primary purchased item is access to a digital program delivered via program.groundya.com access instructions (PDF or email) are only a delivery method and not the core product.

Failure to activate access does not create refund eligibility.

7.3 Physical Products

Returns only where required by law.

8. Educational Disclaimer

Groundya™ is an educational system only.

9. No Medical Advice

No medical advice is provided.

10. No Guarantees

No results are guaranteed.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Groundya™ shall not be liable for any indirect, incidental, or consequential damages arising from the use of the system.

Nothing in these Terms excludes or limits liability where such limitation is not permitted by law, including liability for personal injury caused by negligence or for fraud.

Where liability cannot be excluded, it shall be limited to the amount paid for the product.

11.1 Waiver

You waive claims related to use of materials.

11.2 No Reliance

You do not rely on Groundya™ as professional advice.

11.3 “As Is”

All materials are provided “as is”.

12. Assumption of Risk

By using Groundya™, you acknowledge that self-care practices and the use of natural ingredients may carry a risk of individual reactions.

You agree to use the materials responsibly and to discontinue any practice that causes discomfort.

13. Intellectual Property

All content is owned by Groundya™.

14. Community Rules

We may remove users at any time.

15. User Content

You grant Groundya™ a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share any content you voluntarily submit within the platform (including comments, feedback, photos, or videos), for the purpose of operating the platform and improving the user experience.

Any use of such content for marketing, advertising, or promotional purposes will only occur with your explicit permission.

16. Third-Party Services

We are not responsible for:

  • PayPal

  • Shopify

  • hosting

  • platform tools

17. Governing Law

These Terms are governed by the laws of Poland.

If you are a consumer residing in another country, you may also benefit from mandatory consumer protection provisions of your local law.
